Terms and conditions

These Terms & Conditions apply to your use of the Patternata website, app, design studio, digital products, subscriptions, ordering services and related features.

Patternata is operated by Creative Boutique Limited, a company registered in England and Wales.

By using Patternata, creating an account, purchasing a subscription, downloading digital products, placing an order, or using our design tools, you agree to these Terms & Conditions.

If you do not agree to these terms, you should not use Patternata.

1. About Patternata

Patternata is a digital pattern design studio that allows users to create original patterns using imported artwork, user-created designs, Patternata motif libraries, digital tools, layout features and related creative resources.

Depending on the services available at the time, Patternata may allow users to: create repeat patterns and placement designs; use Patternata motif libraries; upload their own artwork; export designs; download digital motif collections; purchase subscriptions; order custom printed fabrics, scarves or other made-to-order products; access design tools, templates, previews and related services.

Patternata may update, improve, change or remove features from time to time.

2. Your account

You may need to create an account to access certain Patternata features, including saved designs, exports, subscriptions, purchases, motif libraries or ordering services.

You are responsible for: providing accurate account information; keeping your login details secure; all activity carried out through your account; notifying us promptly if you suspect unauthorised access.

We may suspend or close an account if we reasonably believe it has been used fraudulently, unlawfully, in breach of these terms, or in a way that harms Patternata, other users, our systems, our suppliers or our intellectual property.

3. Use of the Patternata design studio

Patternata provides creative tools that allow you to arrange, adapt and combine design elements into original pattern compositions.

You may use Patternata for lawful personal or commercial creative purposes, subject to these terms and any licence terms that apply to specific content, motif libraries, subscriptions or downloads.

You must not use Patternata to: infringe anyone’s copyright, trademark, design rights or other intellectual property rights; upload content you do not own or do not have permission to use; create, upload or distribute illegal, abusive, hateful, exploitative or harmful content; interfere with the operation, security or performance of Patternata; reverse engineer, scrape, copy, extract or reproduce Patternata’s software, motif libraries, content, database, tools, interface or systems; use Patternata to create a competing motif library, clip art collection, stock asset collection, design generator or pattern-making tool.

4. User-uploaded artwork

You may upload your own artwork, images or design assets to Patternata where this feature is available.

By uploading content, you confirm that: you own the content or have permission to use it; your use of the content does not infringe third-party rights; the content does not breach any law or these terms; you are responsible for any claims arising from the content you upload.

You retain ownership of your uploaded artwork. However, you grant Patternata a limited licence to use, store, process, display, preview, render, export and transmit that content solely as needed to provide the Patternata services, including design previews, saved files, exports, printing, fulfilment, technical support and account functionality. We do not claim ownership of your original uploaded artwork.

5. Patternata motif libraries and digital assets

Patternata may provide motif libraries, design elements, templates, artwork collections, clip art, brushes, backgrounds, textures or other creative assets.

Unless stated otherwise, these assets remain owned by Patternata, Creative Boutique Limited, its licensors or its content suppliers.

You may use Patternata motif libraries to create finished pattern designs and finished products, subject to these terms.

You must not: resell Patternata motifs as standalone digital assets; redistribute, share, gift, licence, upload or transfer Patternata motifs as separate files; extract motifs from Patternata libraries for resale or republication; package Patternata motifs into clip art bundles, design packs, Canva templates, stock graphics, digital papers, SVG/PNG collections or similar products; upload Patternata motifs to third-party marketplaces as standalone assets; use Patternata motifs to build or support a competing design tool, motif library, pattern generator, stock asset platform or print-on-demand asset collection.

In simple terms: you may use the motifs to create finished designs. You may not sell the motifs themselves. The cake may leave the kitchen; the recipe does not.

6. Commercial use of user-created designs

Subject to these terms and any plan-specific restrictions, you may use finished pattern designs created by you in Patternata for personal and commercial purposes.

This may include use on: fabrics; scarves; fashion products; stationery; packaging; print-on-demand products; digital previews; marketing materials; other finished end-use products.

However, commercial use is permitted only for finished designs created through your own arrangement, composition or creative use of Patternata tools and assets.

You may not claim ownership of the underlying Patternata motifs, libraries, software, interface, templates or original Patternata content.

7. Free use, watermarked exports and paid features

Patternata may offer free access to certain tools, limited design creation, watermarked previews, trial features or restricted exports.

Free users may be able to create, preview or save designs, but certain features may require a paid subscription or purchase, including: high-resolution exports; watermark-free exports; access to premium motif libraries; additional saved designs; advanced design tools; commercial-ready files; special discounts or member-only benefits.

Where an export is watermarked, you must not remove, obscure, crop out, alter or bypass the watermark unless you have obtained the appropriate paid access or licence.

Patternata may change free and paid feature limits from time to time.

8. Subscriptions

Patternata may offer monthly, annual, lifetime or other subscription plans. The details of each subscription plan, including price, billing period, included features and limitations, will be displayed at the point of purchase.

By purchasing a subscription, you authorise us or our payment provider to charge the applicable fee. Subscriptions may renew automatically unless cancelled before the renewal date. You are responsible for cancelling your subscription before renewal if you do not wish to continue.

Unless stated otherwise: monthly subscriptions renew each month; annual subscriptions renew each year; cancellation stops future renewal but does not automatically refund the current billing period; access may continue until the end of the paid period; subscriptions are for individual use unless a business/team licence is offered.

Patternata may change subscription prices or features, but we will aim to provide reasonable notice where required.

 

9. Lifetime access

If Patternata offers a lifetime access option, “lifetime” means access for the lifetime of the Patternata service, product or relevant platform feature. It does not mean access for the biological lifetime of the customer, the company, the internet, civilisation, or whichever one collapses first.

Lifetime access may still be subject to: technical changes; discontinued features; third-party platform changes; legal restrictions; misuse or breach of these terms; reasonable service evolution over time.

10. Digital downloads

Patternata may sell digital products, including motif collections, downloadable artwork, templates, files or related design resources.

Digital products are usually provided by instant access or download. By purchasing a digital product, you agree that the product may be supplied immediately after purchase. Where applicable, this may affect cancellation rights for digital content. UK online selling rules treat digital content differently from physical goods, and businesses must provide clear pre-contract information to customers.   Unless stated otherwise, digital downloads are licensed, not sold outright. You may use them only in accordance with the applicable licence terms.

You must not resell, redistribute, share, upload, transfer, sublicense or repackage Patternata digital downloads as standalone assets. Due to the nature of digital products, refunds are not normally provided once files have been accessed, downloaded or supplied, unless the product is faulty, inaccessible because of an issue on our side, or your statutory rights require otherwise.

11. Custom printed products

Patternata may allow you to order custom printed fabrics, scarves or other made-to-order products using your own designs or designs created through Patternata. Custom printed products are made specifically for your order.

You are responsible for checking all order details before purchase, including: design layout; scale; colour choices; repeat type; product type; fabric base; scarf size; quantity; delivery address; spelling or text included in the design; image quality and resolution.

We may not be able to cancel or change an order once production has started.

Because custom printed products are made to order, we do not accept returns or cancellations for change of mind, incorrect customer choices, unwanted designs, unsuitable scale, wrong quantity, or colour expectations based only on screen display.

This does not affect your statutory rights. You may still be entitled to a remedy if an item is faulty, damaged, not as described, or does not do what it is supposed to do. GOV.UK states that sellers must offer remedies where goods are faulty, not as described, or not fit for purpose.

12. Colour, scale and print variation

Digital previews are provided as a guide only. Colours may vary between screen display and printed product due to: monitor settings; device display differences; fabric base; print process; dye behaviour; lighting conditions; image resolution; finishing methods.

Small variations in colour, scale, positioning, texture, finish or fabric behaviour are normal in custom textile printing and are not automatically considered faults. Where accurate colour matching is critical, we recommend ordering samples where available before placing larger orders.

13. Production, delivery and third-party fulfilment

Custom printed products may be produced, printed, finished or fulfilled by Patternata, Creative Boutique Limited, or selected third-party suppliers, printers, fulfilment partners or delivery providers. Estimated production and delivery times are not guaranteed unless expressly stated.

We are not responsible for delays caused by: postal or courier disruption; customs checks; incorrect delivery information; failed delivery attempts; supplier delays outside our reasonable control; events beyond our control.

You are responsible for any customs duties, import taxes, local charges or clearance fees that may apply in your country.

 

14. Prices and payments

Prices are shown on the website or app at the time of purchase. Prices may be displayed in different currencies depending on location, platform settings or payment provider functionality. We may change prices at any time, but changes will not affect orders already accepted unless there has been an obvious pricing error. Payments may be processed by third-party payment providers such as Stripe, PayPal, Wix Payments or other providers. We do not store full payment card details ourselves.

Orders and subscriptions are not confirmed until payment has been authorised.

15. Promotions, discounts and member offers

Patternata may offer discounts, launch offers, subscription benefits, promotional codes or member-only offers. Promotions may be changed, withdrawn or limited at any time.

Unless stated otherwise: discounts cannot be exchanged for cash; discounts cannot be applied retrospectively; only one discount may be used per order; promotional codes may have expiry dates or eligibility conditions.

Subscriber discounts, where offered, may be sent by email or displayed within the user account area.

16. Intellectual property

All intellectual property rights in Patternata’s brand, name, logo, website, app, interface, software, code, text, layout, design tools, motif libraries, artwork, templates, images, product photography, documentation and original content belong to Patternata, Creative Boutique Limited, its licensors or its suppliers.

You must not copy, reproduce, modify, distribute, scrape, reverse engineer, sell, license or exploit Patternata intellectual property except as expressly permitted by these terms.

You may not use the Patternata name, logo or branding without our written permission.

17. Third-party services and links

Patternata may include links to third-party websites, platforms, payment providers, fulfilment partners, social media platforms or external services. We are not responsible for third-party websites, services, policies, content, delays, errors or availability.

Your use of third-party services may be subject to their own terms and privacy policies.

18. Availability of Patternata

We aim to keep Patternata available and functioning, but we do not guarantee uninterrupted or error-free access.

We may suspend, update, restrict or remove access to Patternata where needed for: maintenance; security; technical improvements; legal compliance; platform changes; misuse prevention; business or operational reasons.

We are not liable for temporary unavailability, data loss, feature changes or interruptions except where the law says otherwise.

19. Design storage and backups

Patternata may allow users to save designs, projects or account content.

You are responsible for keeping your own copies of important files, artwork, exports and order records. We do not guarantee permanent storage of user designs, especially where accounts are inactive, subscriptions expire, features change, or technical issues occur.

Where possible, we will aim to give reasonable notice before removing major storage features, but we cannot guarantee indefinite access to saved designs.

20. Prohibited conduct

You must not: use Patternata unlawfully; upload infringing or stolen artwork; attempt to access another user’s account; interfere with Patternata’s security or systems; use bots, scrapers or automated tools without permission; extract Patternata motif libraries or databases; remove watermarks without authorisation; copy Patternata’s interface, tools, features or content; use Patternata to produce defamatory, hateful, abusive, exploitative or unlawful material; make false claims about your rights to content; use Patternata in a way that damages our business, suppliers, users or reputation.

We may suspend or terminate access if we believe these terms have been breached.

21. Termination

You may stop using Patternata at any time. We may suspend or terminate your access if: you breach these terms; payment fails; your account is used fraudulently; your use creates legal, technical or reputational risk; we discontinue part or all of the service.

Termination does not affect rights or obligations that have already arisen, including payment obligations, intellectual property restrictions, licence restrictions, and limitations on resale or redistribution of Patternata assets.

22. Refunds and statutory rights

Nothing in these terms limits your statutory rights. For physical goods, UK consumer law gives customers rights where goods are faulty, not as described or not fit for purpose. GOV.UK explains that businesses must offer appropriate remedies in those circumstances.  

For online and distance selling, businesses must provide certain information before customers buy, including details about the trader, goods/services, pricing, delivery and cancellation rights.  

Custom-made, personalised and digital products may have different cancellation rules from standard physical goods, but this does not remove statutory rights where something is faulty or misdescribed.

23. Limitation of liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of rights that cannot be excluded under consumer law.

To the fullest extent permitted by law, Patternata and Creative Boutique Limited will not be liable for: loss of profits; loss of sales; loss of business; loss of opportunity; loss of goodwill; indirect or consequential losses; losses caused by user-uploaded content; losses caused by third-party services; losses caused by incorrect order information supplied by the customer; colour, scale or print variation within normal production tolerance.

Our total liability for any claim relating to a purchase will normally be limited to the amount paid by you for the relevant product or service, except where the law requires otherwise.

24. Business users

If you use Patternata for business purposes, you are responsible for ensuring that your use of Patternata, exported files, printed products and digital assets is suitable for your commercial needs.

Business users are responsible for carrying out their own checks before production, resale, marketing or large-scale manufacturing.

We are not responsible for business losses resulting from design choices, print expectations, production decisions, customer resale issues, third-party marketplace rules or your own commercial use of Patternata outputs.

25. Changes to these terms

We may update these Terms & Conditions from time to time. The updated version will be posted on our website with a revised “last updated” date. If changes are significant, we may notify users by email, account notice or website notice where appropriate.

Continued use of Patternata after changes are posted means you accept the updated terms.

27. Governing law

These Terms & Conditions are governed by the laws of England and Wales. If you are a consumer,  you may also have rights under the laws of the country where you live. Any disputes will be subject to the courts of England and Wales, except where consumer protection laws require otherwise.
